Terms of Service

Effective date: October 14, 2026. Last updated: October 14, 2026

These Terms of Service are the rules for using 89 (paraplan.ai) and the 89 iPhone app.

The short version

  • You must be at least 13 to use 89.
  • Your videos stay yours. You let us host and show them so 89 works.
  • Be kind, be legal, and only post what you have the right to post. Read the Community Guidelines below.
  • We can remove content or accounts that break these rules. You can report or block anyone.
  • 89 is free today and provided "as is." We may add paid features later, but we'll never charge you without your clear OK.

These Terms are a contract. Please read them in full.

1. About these Terms

These Terms of Service ("Terms") are an agreement between you and Know Your Group LLC, a Delaware limited liability company, 3 Germay Dr, Unit 4 #2523, Wilmington, DE 19804, USA ("89", "we", "us"), the maker of the website paraplan.ai and the 89 iPhone app (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and the Community Guidelines in section 6. If you don't agree, please don't use 89.

2. Who can use 89

  • You must be at least 13 years old and old enough to agree to these Terms where you live. If you are under 18, you need a parent or guardian's permission, and they agree to these Terms for you.
  • You can't use 89 if we've banned you before, or if the law doesn't allow you to.
  • One person, one account. Don't share your account or sign in as someone else.
  • If you use 89 for a company or organization, you confirm you're allowed to accept these Terms for it.

3. Your account

  • You can sign in with your phone number (we text you a code), Google, or Apple. Keep access to your phone, email and accounts safe; you're responsible for what happens in your 89 account.
  • Tell us right away at malytskyyo@gmail.com if you think someone else is using your account.
  • Your display name and photo must follow the Community Guidelines. We may suggest a name; you can change it.
  • Text messages: by entering your phone number and tapping to get a code, you agree to receive a one-time login code by SMS at that number. We only send texts you ask for; no marketing. Message and data rates may apply. Message frequency depends on how often you sign in. Reply HELP for help or STOP to stop texts, but then phone sign-in won't work.
  • You can delete your account at any time in Settings → Delete account.

4. Your content

You own your content

You keep all ownership rights in the videos, captions, comments, profile details and other things you post ("Your Content").

The permission you give us

So that 89 can work, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transcode, transcribe, make thumbnails and captions from, display, and distribute Your Content, only to run, protect, improve and promote the Service, and to show it to the people you choose (or, for public videos, to anyone with the link and to members in Stories). We can transfer and sublicense this license only to our service providers (such as hosting and storage companies) and to a successor that takes over 89, and only to run and promote 89. We don't sell Your Content.

Promoting 89

We may use public videos posted on 89, including the creator's name and profile photo, to promote 89 in our app, website, social media and ads. We'll never use private videos or videos from users under 18 for this. If you don't want a public video used, email us at malytskyyo@gmail.com and we'll stop using it in new promotions.

This license ends when you delete Your Content or your account, except: (a) for copies kept for a short time in backups; (b) where others already downloaded or shared it; (c) where we must keep it for legal reasons or to deal with a report.

The permission you give other users

When you post a public video, other people may watch it, share its link and download it, as the Service allows. When you comment, everyone who can view the video can see your comment: for a public video that includes people who aren't signed in, and for a private video anyone who has its link and password. Only post what you're OK with people keeping.

Public and private

A public video can be seen by anyone with the link (even without an account) and by signed-in members in Stories.

Private videos. If you post a video as private, it is hidden from your connections, Stories and your public profile, and only you see it in the app. Anyone who has its link and its password can watch it, so anyone you send them to can forward them to others. Private videos are not encrypted, and we can't guarantee no one else will ever see them. They may be accessed by people you share them with, by people they share them with, because of a technical error or security breach, by our team and service providers when needed to run, secure or moderate 89, or when the law requires it. Don't post anything as private that you couldn't accept becoming public. We may change how private videos work, or remove them, at any time.

Comments on any video can be seen by everyone who can view that video.

Your promises

You promise that you own Your Content or have every right and permission needed to post it, including permission from people who appear or can be heard in it (and from a parent for minors), and that posting it doesn't break the law or anyone's rights.

Feedback

If you send us ideas or feedback, we can use them freely without owing you anything.

5. Our content and the app

89's name, logo, design, software and other content belong to us or our licensors. We give you a personal, non-transferable, revocable right to use the Service as these Terms allow. Don't copy, sell, reverse engineer, or make a competing copy of the Service, except as the law allows.

6. Community Guidelines

89 is for real people sharing short videos with friends and asking for help. Keep it kind, honest and safe. There is zero tolerance for objectionable content and abusive users.

Welcome on 89

  • Short videos about your life, work, ideas, questions and projects.
  • Screen and website recordings, demos, and presentations you have the right to share.
  • Honest feedback and helpful comments, including disagreement, said respectfully.

Not allowed

  • Child safety: any sexual content involving minors, sexualizing or grooming minors, or content that puts minors in danger. We report this to NCMEC and law enforcement.
  • Sexual content: nudity, pornography, or sexually explicit material. No sexual content shared without the consent of the person in it, ever.
  • Violence and threats: threats, encouraging violence, glorifying terrorism or violent extremism, or showing graphic violence or gore.
  • Hate and harassment: attacking people for race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability, age or serious illness; bullying, humiliating, stalking, doxxing, or pushing others to harm themselves.
  • Self-harm: promoting or glorifying suicide, self-harm or eating disorders. If you're struggling, please contact local emergency services or a crisis line (in the US, call or text 988).
  • Privacy: sharing someone's private information (addresses, phone numbers, IDs, financial or medical details), or recording people where they expect privacy without their permission. Some places require everyone's consent to record a conversation; follow the law where you and they are.
  • Screen and website recordings: don't record and post other people's private messages, accounts, paywalled or confidential content (including your employer's), or anything you're not allowed to share.
  • Illegal and dangerous things: selling or promoting illegal drugs, weapons, or regulated goods; fraud; scams; human trafficking; dangerous challenges.
  • Impersonation and deception: pretending to be someone else, fake accounts, misleading deepfakes of real people, or harmful false information.
  • Spam and manipulation: spam, chain messages, fake engagement, bulk or automated accounts, or misleading links.
  • Intellectual property: posting music, videos, shows, or other content you don't own or have permission to use.
  • Scraping and AI training: scraping, crawling, or bulk downloading 89 content or data, or using any 89 content or data to train, fine-tune or build AI or machine-learning models, without our written permission.
  • Attacking the Service: malware, hacking, scraping, abusing login codes, getting around blocks or bans, overloading the Service, or accessing it in ways we don't offer.

What happens if you break the rules

Depending on how serious it is, we may remove content, limit features, suspend your account, or ban you permanently, and report illegal activity to the authorities. Serious violations (such as child safety or credible threats) mean an immediate ban. If you think we made a mistake, email malytskyyo@gmail.com and we'll take another look.

7. Safety tools: report, block and filter

  • Report: you can report any video, comment or profile in the app with Report. Reported content is hidden for you right away. We review reports within 24 hours and remove content that breaks these rules, and remove users who post it.
  • Block: you can block anyone. You won't see each other's content and they can't comment on yours or connect with you.
  • Moderation: we review reports, can remove any content, and can suspend or ban accounts that break these rules.
  • You can also email malytskyyo@gmail.com with a link and what happened.

8. Copyright (DMCA) and other rights

We respect intellectual property and expect you to as well. If you believe content on 89 infringes your copyright, send a notice to our designated agent with:

  • your physical or electronic signature;
  • the work you believe is infringed;
  • the link to the content on 89;
  • your contact information (address, phone, email);
  • a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

Designated agent: Copyright Agent, Know Your Group LLC, 3 Germay Dr, Unit 4 #2523, Wilmington, DE 19804, USA, malytskyyo@gmail.com.

If your content was removed and you believe it was a mistake or you had the right to post it, you can send a counter-notice with: your signature; the removed content and where it was; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; your name, address and phone; and your consent to the jurisdiction of the federal court in your district (or the US District Court for the District of Delaware if you're outside the US) and to accept service from the person who sent the notice. We may restore the content in 10 to 14 business days unless the claimant tells us they filed a lawsuit.

We ban accounts that repeatedly infringe. For trademark, privacy or other rights complaints, email malytskyyo@gmail.com.

9. AI features

Some features use automated tools, such as transcripts and the caption summary (sparkle). These can be wrong, incomplete or unintentionally offensive. Check any suggestion before you post it; you are responsible for what you post. Today caption summaries are made on our own servers by a simple rule-based method, without an outside AI service. If that changes, we'll update these Terms and our Privacy Policy first. Don't use AI features to create content that breaks the Community Guidelines.

10. Stories and your daily hour

You can watch Stories during your own one-hour window each day (we call it 8–9 PM). How Stories, the daily hour, notifications and other features work may change over time.

11. Connected assistants and other services

89 lets you connect outside apps and services, such as AI assistants, Google or Apple sign-in, and links to other websites. Those are run by others under their own terms and privacy policies, and we aren't responsible for them. You can disconnect assistants at any time in Settings.

12. Changes to the Service

89 is new and changing fast. We may add, change, or remove features, or stop the Service, at any time. To the extent the law allows, we have no liability to you for changing or stopping the Service or any feature. If we shut down 89, we'll try to give you at least 30 days' notice and a chance to download your videos before the shutdown.

Free and paid features

89 is free today. We may add paid features or plans, and features that are free now may become paid later. We'll tell you before a feature you use becomes paid, and we'll never charge you without your clear OK. Prices can change; we'll show the price before you buy. Purchases and auto-renewing subscriptions in the iPhone app are handled by Apple under Apple's rules: Apple charges you, you manage or cancel auto-renew in your Apple account settings, and refunds go through Apple. Taxes may apply.

Disputes between users

If you have a dispute with another user, it's between you and them. We're not a party to it and have no duty to get involved, though we may act on reports under these Terms.

13. Ending your use of 89

You can stop using 89 and delete your account at any time. We may suspend or end your access if you break these Terms, if we must for legal reasons, or to protect users or the Service. Sections that by their nature should continue (such as ownership, disclaimers, liability limits and disputes) still apply after your account ends.

14. Disclaimers

89 is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Service will always be available, secure or error-free, or that content will be kept forever, so keep your own copies of important videos. We aren't responsible for content posted by users. Some places don't allow these disclaimers, so they may not all apply to you.

15. Limits on our liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of 89. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the last 12 months or US $50. These limits don't apply where the law doesn't allow them (for example, for death or personal injury caused by negligence, or fraud).

16. Your responsibility to us

If someone makes a claim against us because of Your Content or your breaking these Terms or the law, you agree to cover our reasonable losses and costs (including legal fees), to the extent the law allows.

17. Disputes and governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be handled only in the state or federal courts located in New Castle County, Delaware, and you and we agree to their jurisdiction, except that either of us can bring a claim in small claims court where you live. There is no mandatory arbitration. This doesn't take away any rights you have under the consumer protection laws of the place you live (for example California). Please contact us first at malytskyyo@gmail.com so we can try to solve the problem informally within 30 days.

If you live in the EU, UK or another country with consumer protection laws, you keep the protections of your local law and can bring claims in your local courts.

18. Apple App Store terms

If you got the 89 app from the Apple App Store:

  • These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
  • Your license to use the app is limited to Apple devices you own or control, as allowed by the App Store Terms of Service.
  • Apple has no duty to provide maintenance or support for the app.
  • If the app fails to meet a warranty, you can tell Apple, and Apple may refund the purchase price (if any). Apple has no other warranty duty for the app.
  • Apple is not responsible for any claims by you or others about the app, including product liability, legal or regulatory compliance, or consumer protection claims.
  • If someone claims the app infringes their intellectual property, we (not Apple) are responsible for dealing with it.
  • You confirm you're not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
  • Questions or complaints about the app go to us at malytskyyo@gmail.com, Know Your Group LLC, 3 Germay Dr, Unit 4 #2523, Wilmington, DE 19804, USA.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.

19. Changes to these Terms

We may update these Terms. We'll change the date at the top and, for important changes, tell you in the app or by email before they take effect. If you keep using 89 after that, you accept the new Terms. If you don't agree, you can delete your account.

20. Other legal terms

  • These Terms, the Privacy Policy and Community Guidelines are the whole agreement between us about 89.
  • If part of these Terms can't be enforced, the rest still applies.
  • If we don't enforce a part right away, we haven't given up the right to do it later.
  • You can't transfer these Terms to someone else. We may transfer them if 89 is sold or merged.
  • Neither of us is responsible for delays caused by things outside our reasonable control.
